1. What is Notarization

• Notarization is the system to officially prove existence of specific documents, facts or legal relationships as part of preventive function of private law for the purpose of preserving evidence and facilitating enforcement of rights of the right-holders arising from transactions entered into.

2. Why Notarization is Necessary

• The notarized documents are acknowledged as having strong probative values in the trial process; and in case the agreement between contracting parties is notarized, the allegation to the contrary is practically banned, which is favorable to the aggrieved party when disputes arise later.
• Moreover, if a debtor approves in advance a compulsory execution of the claim to monetary payment by means of an official, notarized certificate, a compulsory execution can be enforced with the same effect as the court’s final judgment.

3. Notarization of Will

• Testator : ID (resident registration card; or driver’s license); Registered Personal Seal; Certificate of resident registration; and Certificate of family relations
• Two (2) Witnesses : ID (resident registration card; or driver’s license); Certificate of resident registration; Certificate of Basic Information; and Certificate of non-Guardianship
  registration (*)
• (*)Witnesses need to get the credit-check (신용조회) prior to the will notarization. In case he/she is not a Korean national, credit-check through a governmental system is not possible.
• Testamentary Donee : Certificate of resident registration
• Executor(**) Certificate of resident registration; Certificate of Basic Information
• (**) It is possible a testamentary donee be the executor.
• Testamentary Gift : Building Register; and Certificate of Court Registered Items, etc.
